IQOS TOGETHER X Sensorium Raffle Promotion Terms & Conditions

 

The IQOS Together X Sensorium Raffle Promotion 2024 offer with details provided in ANNEX A (“Offer”) is open to legal age users who are at least 20 years old (as of the date of his/her participation in the Offer) and above residing in the Philippines who otherwise wish to continue to use tobacco or nicotine containing products (“Customer”). 

I. GENERAL

1. This Offer is being carried out by ActivAsia Inc. (“AAI”) as an authorized distributor of PMFTC products. IQOS Stores are operated by AAI and IQOS coaches are authorized sales representatives of AAI. IQOS.com is owned by Philip Morris International and its affiliate in the Philippines, PMFTC Inc ("PMFTC") and the online store of IQOS.com is operated by AAI, and all orders are fulfilled by AAI, as an authorized distributor of PMFTC products sold in IQOS Stores and IQOS.com. Deliveries are carried out by AAI or by AAI’s authorized third-party delivery providers.

2. PMFTC/AAI reserves the right to modify, change, or revise the rules and mechanics of the Offer.

3. Customers using multiple IQOS.com accounts to participate in the Offer are disqualified. PMFTC/AAI reserves the right to disqualify any Customer if there is any evidence of fraud or irregularities in his/her participation in the Offer.

4. PMFTC/AAI reserves the right to hold, suspend or block a Customer’s IQOS.com account due to suspicious, fraudulent or illegal activity.

5. PMFTC/AAI reserves the right to cancel, amend, or revoke these terms and conditions without notice in the event of fraudulent activity, cheating, a security breach or any anticipated breach of any applicable law or regulation, an event or disturbance outside of PMFTC’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, pandemic or war. Any changes to the Offer will be announced accordingly.

6. By participating in the Offer, Customer confirms his/her consent to process his/her personal data provided as part of the Offer. Details of such processing are described in Philip Morris International’s (PMI) Consumer Privacy Notice found at https://www.pmiprivacy.com/en/consumer and AAI’s Data Privacy Consent Policy.

7. Important information: This product is harmful and contains nicotine which is a highly addictive substance. This is for use only by adults and is not recommended for use by non-smokers. Please visit IQOS.com to find out more about Philip Morris International’s Good Conversion Practices.

II. AGE VERIFICATION AND DELIVERY; REFUND FOR FAILED DELIVERY

1. The Customer will be subject to age verification process wherein he/she will be requested to submit a valid Government Issued ID before items can be purchased and/or delivered to the Customer. The following valid Government Issued IDs as proof of age: Passport, Alien Certificate of Registration, Driver's License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter's ID.

2. In cases where Customer cannot accept the delivery, an authorized representative who is at least twenty (20) years old and above can claim on behalf of the Customer provided the following documents are presented to the courier:

a) Valid government issued ID of representative for identity check and age verification

b) Copy of a valid government issued ID of Customer for identity check and age verification

c) Signed authorization letter indicating the order reference number and stating that the Customer is authorizing the representative to receive the orders.

The courier will not be able to proceed with the transaction if any of the above-required documents are not presented.

3. For deliveries, the courier will communicate and coordinate details, with delivery attempt at a maximum of two (2) times. A third delivery attempt will be available in selected cities that offer same/next day delivery; and can be arranged with an additional delivery fee that will be communicated in advance by AAI/courier, and to be confirmed by the Customer. In the event of failure to receive the delivery for credit card or GCash transactions, normal refund process will be followed:

For credit card transactions:

For Credit Cards issued locally: Refund will take up to 10 working days but also subject to issuing bank lead times

For Credit Cards issued abroad: Refund will take up to 45 days, but also subject to issuing bank lead times

You may check the status of your refund with your issuing bank.

4. For GCash transactions, refund must be coursed through IQOS Customer Care team. The Customer shall call IQOS Customer Care team to trigger the refund process and will be able to credit back to the Customer’s GCash account real time.

III. OTHERS

1. IQOS.com website may be subject to possible technical and system issues. We will provide the necessary notice to the Customers if such is the case.

2. All decisions of PMFTC and/or AAI and its agents in all matters relating to the interpretation and implementation of this terms and conditions, including the mechanics are final, and no objections and/or appeals thereon will be entertained.

3. Customers availing the Offer agree and confirm the following:

  • that you are a legal-age smoker at least 20 years old or above as of the date of his/her participation in the Offer;
  • that you have read and understood the terms and conditions detailed herein;
  • that you agree to follow the applicable mechanics of the Offer;
  • that you agree to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC and/or AAI, its affiliates and all other persons and entities connected with the Offer from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that you may sustain, no matter how any such property losses and/or injuries are caused.

5. PMFTC/AAI will not be liable to the Customer for any taxes, costs, liabilities or expenses that may arise from this Offer.

 

ANNEX A

MECHANICS

1. Eligibility/Who Can Avail:

(a) Customers who are existing legal age IQOS users who are registered in the IQOS.com website (“IQOS Users”) are eligible to participate in the Offer as long as they avail of any one of or all of the following programs (“Eligible Promos”):

(b) Only existing IQOS Users who avail of the Eligible Promos during the period of August 1, 2024 to September 12, 2024 are eligible to participate in this Offer. 

(c) Employees of PMFTC, its affiliates, distributors, advertising and promotions agencies, companies involved in the promotion, their agents, as well as their respective relatives up to the 2nd degree of consanguinity or affinity are not eligible to join or win in this Offer.

2. Duration of the Offer and Where to Avail

(a) For the Eligible Promos, the Offer can be availed during the period indicated in the table in Section 1(a) of these Mechanics/Terms and Conditions for the IQOS TOGETHER X Sensorium Raffle Promotion 2024. 

(b) Promo duration for the Offer is from August 1, 2024 to September 12, 2024. PMFTC/AAI has the sole discretion to shorten or extend the Offer period if circumstances so warrant.

(c)The Offer can be availed at or through the following:

(i) Official IQOS Stores (physical)

(ii) IQOS.com (online store)

(iii) IQOS Coaches

(iv) IQOS Pop-Up Stores

IQOS Pop-up Stores are deployed in various locations in Metro Manila operated by IQOS Field Sales Experts where a Customer may avail of the Offer. IQOS Pop-up Store locations are provided in SCHEDULE 1.

(v) IQOS Partners

IQOS Partners are select establishment in various locations that are authorized to distribute PMFTC products. IQOS Partner locations are provided in SCHEDULE 2. 

3. Specific Terms of the Offer, including the IQOS Together X Sensorium Tokyo 2024 and Together X Sensorium Tokyo Trip:

(a) Promo Mechanics: The following are the different ways an IQOS User can earn a raffle entry and participate in the Offer through the Eligible Promos.

Raffle entry means specific to the Offer, a raffle entry for an IQOS User that allows him/her a chance to win prizes, including an all-expense paid trip for two (2) to Tokyo Japan from October 17, 2024 to October 20, 2024, including the chance to attend the IQOS Together X Sensorium Tokyo Event in Tokyo, Japan with Steve Aoki as one of the guest performers for that event (“IQOS Together X Sensorium Tokyo 2024”). The trip for two (2) to Tokyo Japan as one of the prizes of the IQOS Together X Sensorium Raffle Promotion 2024 and to attend the IQOS Together X Sensorium Tokyo 2024 is referred to as “Together X Sensorium Tokyo Trip”. Having a raffle ticket does not automatically entitle the IQOS User to receive the prize(s).

(i). REFER A FRIEND: An IQOS user who refers a friend* will receive Php200 IQOS Voucher, IQOS Club points and 1 raffle entry for the IQOS Together X Sensorium Raffle Promotion 2024 for every successful referral (in accordance with the terms and conditions of the Refer-A-Friend promotion as provided in https://www.iqos.com/ph/en/terms-and-conditions/refer-a-friend.html)

  • A successful referral is made according to the mechanics provided in Annex A(1)(e) of the Refer-A-Friend Promo Terms and Conditions https://www.iqos.com/ph/en/terms-and-conditions/refer-a-friend.html
  • An IQOS User gets 1 raffle entry to the IQOS Together X Sensorium Raffle Promotion 2024 for every successful referral. The maximum number of referrals is 30 referrals .

(ii). ILUMA TRADE-IN: An IQOS Club Member who swaps his/her current IQOS device (not any of the IQOS ILUMA models but is linked to their IQOS.com account) to IQOS ILUMA device or IQOS ILUMA One device will receive one (1) raffle entry for the IQOS Together X Sensorium Raffle Promotion 2024. The IQOS ILUMA Trade-in terms and conditions as provided in IQOS ILUMA Trade-In Terms & Conditions | IQOS Philippines continue to apply for the trade-in mechanics. 

(iii). TOKYO TAKEBACK: Existing IQOS Users with a non-IQOS ILUMA device (i.e., device is not IQOS ILUMA Prime, IQOS ILUMA or IQOS ILUMA One) that is not linked to their IQOS.com account (Non-Linked/Non-IQOS ILUMA Device) may swap such device and avail of a Php250 discount. 

  • The following devices Non-Linked/Non-IQOS ILUMA Device may be swapped for an IQOS ILUMA One or IQOS ILUMA device: IQOS 2.4, IQOS 2.4 Plus, IQOS 3.0 Multi, IQOS 3.0 Duo, IQOS Originals Duo, IQOS Originals One, Bonds by IQOS
  • IQOS Users who trade-in or swap their Non-Linked/Non-IQOS ILUMA Device during the Offer period may use the code “TOKYOTAKEBACK” that entitles the IQOS User a Php250 discount when they purchase either an IQOS ILUMA One device or IQOS ILUMA device. This TOKYOTAKEBACK discount cannot be applied for the purchase of an IQOS ILUMA Prime device, ZYN, HEETS, TEREA, BONDS by IQOS or any accessories.
  • An IQOS User who already availed of the IQOS ILUMA Trade-In will not be eligible to avail of the Tokyo Takeback 2024 promotion.
  • An IQOS User can only avail of the Tokyo Takeback 2024 once and the IQOS User can only use the TOKYOTAKEBACK code from August 5, 2024 to September 12, 2024.

b. Proof of raffle participation

(i) A confirmation message will be sent via the IQOS User’s registered email address in IQOS.com or via SMS through their registered mobile number in IQOS.com. This confirmation message as seen in Schedule 3, will serve as proof that the Customer has successfully availed of any of the Eligible Promos and received the raffle entry(ies).

(ii) IQOS Users are encouraged to check to check spam/junk folders as there may be accidental redirects of the email messages.

(iii) Receiving this confirmation message, whether by email or SMS, does not automatically intitle the IQOS User to receive the prize (s).

c. Selection and qualification of winners

(i) Unless notified otherwise, the selection of the winners for the IQOS Together X Sensorium Raffle Promotion 2024 will be drawn randomly and conducted electronically, through an electronic raffle draw system and selected winners will be declared as winners of the IQOSthe IQOS Together X Sensorium Raffle Promotion 2024 promo.

(ii) Unless otherwise provided here, the selection of the winners will be final.

(iii) To be qualified as a winner, there must be no evidence of fraud, irregularity, or illegal acts. PMFTC reserves the right to conduct checks and verifications on any selected winner for purposes of complying PMFTC’s policies and procedures and applicable laws, and select alternative winners if PMFTC reasonably believes that the distribution of the prizes to such winners would be in breach of PMFTC’s policies, these terms and conditions or any applicable laws.

d. Raffle winners, raffle draw schedule and prizes to be given away

(i) All IQOS Users who qualified will be part of the electronic raffle draw. The electronic raffle draw will be conducted by authorized representative of PMFTC Inc.

There will be a total of 174 prizes to be given away for the IQOS Together X Sensorium Raffle Promotion 2024. There will be two (2) types of raffle draw and prizes to be given away (Minor Draw/Minor Prize and Grand Draw/Grand Prize)

Grand Prize

(i) Winners that are drawn from the raffle entries will be subject to among others age and identity verification.

(ii) Those who won a minor prize may still be included for the draw/selection of the grand prize 

(iii) Prizes under this Offer are not transferrable and cannot be converted to cash

(iv) Separate Terms and Conditions will be provided specific to the Together X Sensorium Tokyo trip (grand prize)

e. Notification of raffle winners:

(i) Raffle winners will be notified via email and call by PMFTC’s authorized representative. By participating in the Offer, IQOS Users are encouraged to check to check spam/junk folders for the prize notification as there may be accidental redirects of the prize notification email to their spam/junk folder.

(ii) PMFTC’s representative will attempt to contact the winner three (3) times. If the winner is still unresponsive, raffle prize will be forfeited.

(iii) Winners of the IQOS Together X Sensorium Raffle Promotion 2024 shall undergo verification, where they will be required among others to submit a valid government issued ID within three (3) days from the date they are notified and proof of the email/sms communication sent to them. If any winner fails to submit their government issued ID and/or does not meet the eligibility requirements, he/she will be disqualified, and his/her prize will be deemed forfeited. PMFTC reserves the right to draw other winners and be subject to the same eligibility verification process.

(iv) When claiming their prizes, all winners of the IQOS Together X Sensorium Raffle Promotion 2024 agree to provide their consent that their names will be published in IQOS.com

f. Claiming of raffle prizes

(i) Once verified, these verified winners (i.e. completed the submission of the government issued ID and are eligible to claim the prize in accordance with these terms and conditions), should claim their prize. If any of the minor prizes remains unclaimed within 60 days after the end of the Offer period, it will be automatically forfeited. If any winner is not qualified or not eligible or their proof of fraud, irregularity or illegal acts, then the prize is automatically forfeited and the sixty (60) days period to claim the prize will not apply and PMFTC reserves the right to at any time choose another winner.

(ii) For the grand prize because it involves travel arrangements and advance preparations, the winners should claim it on the specified date indicated here otherwise, it is automatically forfeited if not claimed on time.

(iii) Winners of the IQOS Together X Sensorium Raffle Promotion 2024 (both minor prize and grand prize winners) will be invited to attend a dinner (details, including date and venue to be announced by PMFTC and winners will be informed in advance) where they can claim their respective prizes. If a winner will be unable to claim it during this dinner event, they may opt to claim their prize in the nearest IQOS store:

  • Aug 23 and 30 winners – can claim their prize by Sept. 6, 2024
  • Sept 3-12 winners – can claim their prize by Sept. 13, 2024
  • Sept 13 (grand prize) winners – can claim their prize by Sept 17, 2024

(iv) Winners of the grand prize agree to comply with the additional terms and conditions for the Together X Sensorium Tokyo Trip as may be informed by PMFTC to them from time to time and sign all required agreements/documentations for the Together X Sensorium Tokyo Trip.

(v) Winners of the grand prize and their respective one (1) adult companion must be able to comply with all travel requirements including but not limited to have a valid passport, are fit to travel and satisfy the visa requirements (if applicable).

g. Others

(i) In case of suspicious, illegal or fraudulent activities with respect to the use of any codes for Offer, PMFTC/AAI reserves the right to hold, suspend or block a Customer’s IQOS.com account or cancel any transaction that is part of the Offer/Eligible Promos.

(ii) Unless otherwise provided in these Offer terms and conditions, the Offer cannot be combined with other special offers, promotions or vouchers.

(iii) Customers/winners in the Offer agree to be bound by these mechanics, and by all decisions of PMFTC and its agents on all matters related to its implementation.

(iv) PMFTC will only shoulder final withholding taxes on prizes amounting to more than PhP10,000. Except as expressly provided herein, PMFTC will not be liable to the winners for any taxes, costs, liabilities or expenses that may arise out of the use of the prizes.

(v) Prizes are supplied with standard supplier’s or service provider’s warranties only, where available. PMFTC and its agents are not liable for any warranty whatsoever, over the prizes, which is the sole liability of the supplier/merchant/service provider of the prizes. PMFTC and its agents will not be liable with respect to: (i) any injury or consequential loss or damage arising from the use of prizes; and (ii) any supplier/merchant/service provider’s refusal to honor any warranty. PMFTC is not associated with any supplier/merchant/service provider of the prizes and is not responsible for any issues related to the usage of prizes. Except for the grand prize, any questions regarding the prize should be directed to the supplier/merchant/service provider of the prize.

(vi) Prizes are non-transferrable. Prizes in kind are not convertible to cash.
