IQOS TRIAL OFFER TERMS AND CONDITIONS

I. GENERAL

1. The IQOS TRIAL OFFER (the “Offer”) allows eligible adult smokers and users of other nicotine products 18 years old and above to borrow a IQOS ILUMA Trial Kit or Bonds by IQOS Trial Kit for an extended trial period. 

2. IQOS Stores are operated by. IQOS.com is owned by Philip Morris International and its affiliate in the Philippines, PMFTC Inc ("PMFTC"). The online store of IQOS.com is operated by ActivAsia Inc. (or "AAI"), and all orders are fulfilled by AAI, as an authorized distributor of PMFTC products sold in IQOS Stores and IQOS.com. Deliveries are carried out by AAI or by AAI’s authorized third-party delivery providers. This Offer is being carried out by AAI as an authorized distributor of PMFTC products. 

3. The Offer period is from April 1, 2024 to December 31, 2024. PMFTC/AAI has the sole discretion to shorten or extend the Offer period if circumstances so warrant.

4. PMFTC/AAI reserves the right to modify, change, or revise the rules and mechanics of the Offer.

5. Customers who use multiple IQOS.com or IQOS accounts to participate in the Offer will be disqualified. PMFTC/AAI reserves the right to disqualify any Customer if there is any evidence of fraud or irregularities in his/her participation in the Offer.

6. PMFTC/AAI reserves the right to hold, suspend or block a Customer’s IQOS Club, IQOS.com and or IQOS account due to suspicious, fraudulent or illegal activity

7. PMFTC/AAI reserves the right to cancel, amend, or revoke this Offer without notice in the event of fraudulent activity, cheating, a security breach or any anticipated breach of any applicable law or regulation, an event or disturbance outside of PMFTC/AAI’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, pandemic or war. Any changes to the Offer will be announced accordingly. 

8. This product is harmful and contains nicotine, which is a highly addictive substance. This is for use only by adults and is not recommended for use by non-smokers. Only for use by adults 18 years old and above who would otherwise continue to smoke or use other nicotine products. II. MECHANICS

1. The Offer is open to legal age consumers (“LAC”) who: 

a. are 18 years old and above; 

b. resides in the National Capital Region, Philippines;

c. who smoke or use other nicotine-containing products who would otherwise continue to use tobacco or nicotine containing products; and

d. fit into the following requirements

 

2. Effective April 1, 2024 the following trial options are available for eligible LACs.

3. LACs can avail of the Offer by:

a. Signing up at IQOS.com Try page

b. The LAC will be contacted by an IQOS Customer Care agent to check the LAC’s eligibility and confirm LAC’s agreement to the Offer’s terms and conditions.

c. Once confirmed, the IQOS Customer Care agent shall arrange for delivery of the purchased packs and the Trial Kit to the LAC.

d. Upon delivery, the LAC will be subject to the age verification process where he/she will be required to present to the courier a valid GIID. 

e. The purchase requirement must be processed upon delivery. Upon payment, the courier shall hand over to the trial kit and freebie to the LAC. 

f. The courier shall likewise present a copy of the Trial Program Agreement and collect the LAC’s signature on the same. The LAC should sign 2 sets of the Trial Program Agreement and retain 1 set for himself/herself and provide the other signed original set to the courier for AAI’s records.

4. Offer allows the LAC to use the Trial Kit for seven (7) Calendar days (the “Original Trial Period”) with the option to extend for another 7 Calendar days (the “Trial Extension Period”), and/or decide to purchase an IQOS device of their choice.

5. During the trial period, the LAC is provided the following support: 

a. Guided Trial via delivery team or Virtual Guided Trial via remote coaches within seven (7) calendar days from the hand-over of the Trial Kit. 

i. In the event that the LAC is uncontactable during the scheduled Guided Trial/Virtual Guided Trial, the IQOS Coach will attempt to contact the LAC within three (3) days from the scheduled appointment date. In case of the LAC’s failure to complete the Guided Trial within the scheduled period or in case the LAC becomes unreachable within 3 days from the scheduled appointment, PMFTC shall have the right to immediately retrieve the trial kit provided thru its authorized distributor, AAI. To ensure an effective Guided Trial:

ii. In case of a physical Guided Trial, it should be conducted within premises/ locations where use of the IQOS device is allowed

iii. In case of a Virtual Guided Trial, 

1) The Virtual Guided Trial must be conducted on the online video conferencing platform using the link provided to the LAC.

2) LAC’s video conferencing capability must include access to and availability of internet connection, video conferencing device (mobile phone, tablet, laptop or desktop computer) and video conferencing platform.

3) LAC needs to allocate around 20 minutes but not more than 30 minutes for the physical Guided Trial or Virtual Guided Trial session.

4) LAC must choose a conducive location and environment that will allow him/her to use the IQOS device and chat comfortably with an IQOS Coach. LAC agrees to comply with existing laws and regulations in choosing the location/environment for the conduct of the Virtual Guided Trial and ensure that no persons below 18 years old will be able to view the Virtual Guided Trial session and LAC shall not be in locations where smoking/vaping is prohibited.

5) The LAC must have his/her video conferencing device’s camera on throughout the duration of the Virtual Guided Trial. The IQOS Coach has the prerogative to pause or stop the Virtual Guided Trial in case of any potential and actual violations to existing laws and regulations, and if there is confirmed or suspected presence of persons below 18 years old.

b. An assigned IQOS Coach providing hypercare support in the form of a series of communications - check-in calls, SMS, emails to provide relevant information about IQOS and their trial experience 

6. LAC is expected to handle, use, and safekeep the Trial Kit in accordance with the user guides provided in the kit. If during the Trial Period, the LAC breaks/damages the device assigned to them and requests for a replacement, he/she should satisfy the conditions outlined in Annex A

7. At any time during the Trial Period, LAC can express his/her intent to purchase a device by informing the IQOS Coach during any of the scheduled check-in calls or contacting IQOS Customer Care using any of the contact details listed below. Purchase of the device can be transacted thru the following channels: IQOS Coach, IQOS.com and IQOS Store. The IQOS Coach shall then arrange for the LAC to return the Trial Kit.

8. PMFTC and/or its authorized representative will verify the identity and age of each Customer. Customers who fail to pass the verification procedure (e.g. age non-eligibility) shall be informed that they are not eligible to avail of the Offer.

9. When the LAC decides to purchase a device during the Trial period, or when the LAC finishes the Trial Period, the LAC shall return the Trial Kit in accordance with the guidelines outlined in Annex B. 

III. DELIVERY 

1. Customer will be subject to age verification process where he/she will be required to present a valid Government Issued ID before the Offer can be claimed.

2. To facilitate the delivery from IQOS.com, Customer must present any of the following valid Government Issued IDs as proof of age: Passport, Alien Certificate of Registration, Driver’s License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter’s ID.

3. In cases where Customer cannot accept the delivery, an authorized representative who is at least eighteen (18) years old and above can claim on behalf of the Customer provided the following documents are presented to the courier:

a. Valid government issued ID of representative for identity check and age verification

b. Copy of a valid government issued ID of Customer for identity check and age verification

c. Signed authorization letter stating that the Customer is authorizing the representative to receive the trial kit and respective packs. The authorization letter will be surrendered to the courier, including the signed trial agreement form on behalf of the LAC.

4. The courier will not be able to deliver the Customer’s trial kit and respective packs if any of the above-required documents are not presented.

5. For deliveries, the courier will communicate and coordinate details, with delivery attempt at a maximum of two (2) times. A third delivery attempt will be available in selected cities that offer same/next day delivery; and can be arranged with an additional delivery fee that will be communicated in advance by AAI/courier, and to be confirmed by the Customer 

IV. OTHERS

1. All decisions of PMFTC and/or AAI and its agents in all matters relating to the interpretation and implementation of this mechanics are final, and no objections and/or appeals thereon will be entertained.

2. Customers in the Offer agree and confirm the following:

a. that you are a legal-age smoker, 18 years old or above as of the date of his/her participation in the Offer; 

b. that you have read and understood the terms and conditions detailed herein; 

c. that you agree to follow the applicable mechanics of the Offer; 

d. that you agree to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC and/or AAI, its affiliates and all other persons and entities connected with the Offer from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that you may sustain, no matter how any such property losses and/or injuries are caused.

4. Devices bought by Customers using IQOS Store vouchers, special offers or through promotional activities are non-refundable.

5. PMFTC will not be liable to the Customers for any taxes, costs, liabilities or expenses that may arise from this Offer.
