Terms & Conditions
TOGETHER X: A PLEASURABLE CELEBRATION with 2024 details provided in ANNEX A (“Event”) is open to legal age users who are at least 18 years old (as of the date of his/her participation in the Event) and above residing in the Philippines who otherwise wish to continue to use tobacco or nicotine containing products (“Customer”). The Event is on July 27, 2024, at BGC Immersive, One Bonifacio High Street, Taguig City.
I. GENERAL
1. This Offer is being carried out by ActivAsia Inc. (“AAI”) as an authorized distributor of PMFTC products. IQOS Stores are operated by AAI and IQOS coaches are authorized sales representatives of AAI. IQOS.com is owned by Philip Morris International and its affiliate in the Philippines, PMFTC Inc ("PMFTC") and the online store of IQOS.com is operated by AAI, and all orders are fulfilled by AAI, as an authorized distributor of PMFTC products sold in IQOS Stores and IQOS.com. Deliveries are carried out by AAI or by AAI’s authorized third-party delivery providers.
2. PMFTC/AAI reserves the right to modify, change, or revise the rules and mechanics of the Offer.
3. Customers using multiple IQOS.com accounts to participate in the Offer are disqualified. PMFTC/AAI reserves the right to disqualify any Customer if there is any evidence of fraud or irregularities in his/her participation in the Offer.
4. PMFTC/AAI reserves the right to hold, suspend or block a Customer’s IQOS.com account due to suspicious, fraudulent or illegal activity.
5. PMFTC/AAI reserves the right to cancel, amend, or revoke these terms and conditions without notice in the event of fraudulent activity, cheating, a security breach or any anticipated breach of any applicable law or regulation, an event or disturbance outside of PMFTC’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, pandemic or war. Any changes to the Offer will be announced accordingly.
6. By participating in the Offer, Customer confirms his/her consent to process his/her personal data provided as part of the Offer. Details of such processing are described in Philip Morris International’s (PMI) Consumer Privacy Notice found at https://www.pmiprivacy.com/en/consumer and AAI’s Data Privacy Consent Policy.

II. AGE VERIFICATION AND DELIVERY; REFUND FOR FAILED DELIVERY
1. The Customer will be subject to age verification process wherein he/she will be requested to submit a valid Government Issued ID before items can be purchased and/or delivered to the Customer. The following valid Government Issued IDs as proof of age: Passport, Alien Certificate of Registration, Driver's License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter's ID.
2. In cases where Customer cannot accept the delivery, an authorized representative who is at least eighteen (18) years old and above can claim on behalf of the Customer provided the following documents are presented to the courier:
a) Valid government issued ID of representative for identity check and age verification
b) Copy of a valid government issued ID of Customer for identity check and age verification
c) Signed authorization letter indicating the order reference number and stating that the Customer is authorizing the representative to receive the orders.
The courier will not be able to proceed with the transaction if any of the above-required documents are not presented.
3. For deliveries, the courier will communicate and coordinate details, with delivery attempt at a maximum of two (2) times. A third delivery attempt will be available in selected cities that offer same/next day delivery; and can be arranged with an additional delivery fee that will be communicated in advance by AAI/courier, and to be confirmed by the Customer. In the event of failure to receive the delivery for credit card or GCash transactions, normal refund process will be followed:
For credit card transactions:
For Credit Cards issued locally: Refund will take up to 10 working days but also subject to issuing bank lead times
For Credit Cards issued abroad: Refund will take up to 45 days, but also subject to issuing bank lead times
You may check the status of your refund with your issuing bank.
4. For GCash transactions, refund must be coursed through IQOS Customer Care team. The Customer shall call IQOS Customer Care team to trigger the refund process and will be able to credit back to the Customer’s GCash account real time.
III. OTHERS
1. IQOS.com website may be subject to possible technical and system issues. We will provide the necessary notice to the Customers if such is the case.
2. All decisions of PMFTC and/or AAI and its agents in all matters relating to the interpretation and implementation of this terms and conditions, including the mechanics are final, and no objections and/or appeals thereon will be entertained.
3. Customers availing the Offer agree and confirm the following:
- that you are a legal-age smoker at least 18 years old or above as of the date of his/her participation in the Offer;
- that you have read and understood the terms and conditions detailed herein;
- that you agree to follow the applicable mechanics of the Offer;
- that you agree to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC and/or AAI, its affiliates and all other persons and entities connected with the Offer from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that you may sustain, no matter how any such property losses and/or injuries are caused.

5. PMFTC/AAI will not be liable to the Customer for any taxes, costs, liabilities or expenses that may arise from this Offer.
ANNEX A
MECHANICS
1. Participant Requirements
i. Participants. TOGETHER X: A Pleasurable Celebration 2024 (“Event”) RSVP is a private gathering and by-invitation only open only to selected IQOS CLUB Members and their adult companion and Media Partners (“Participant/s”).
1. Customers who are also IQOS CLUB Members who are adult nicotine users who are at least 18 years old (as of July 27, 2024) residing in the Philippines who otherwise wish to continue to use tobacco or nicotine-containing products. 2. Each IQOS CLUB Members has the option to bring one (1) companion to the Event, provided said companion is an adult (at least 18 years old as of July 27, 2024) smoker or nicotine product user.
ii. Access. The Participant will get a chance to join the Event through registering in the microsite sign up platform.
1. RSVP. The (“RSVP”) invite is contingent on whether the Participant is successfully able to register to “Microsite.” Based on the successfully registered Participants in the Microsite, the Participant will receive an SMS or Viber message at least 24 hours after signing up for confirmation. The Participant will get the chance to join the Event if they are able to confirm “RSVP” within the allocated number of slots of 200 Participants for the Event, which already includes 50 slots for IQOS Club Members and a corresponding 50 slots for the adult companion of the IQOS Club members.
Participants who confirm attendance within the number of slots for the Event will be allowed access to the Event.
2. Content. The Participant acknowledges and agrees that PMFTC Inc. in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to the Event name, themes, content, program, performers, hosts, moderators, venue, and time. Event content shall be recorded by PMFTC Inc. and/or its service providers.
3. Use of Likeness. By participating in the Event, the Participant acknowledges and agrees to grant PMFTC Inc. and/or its authorized service providers the right to record, film, live stream, photograph, or capture his likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval or any payment to the Participant. This grant includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to use or disseminate the media.
2. Registration Confirmation
i. Waitlist. The first invitation (“Waitlist”) will be sent to the Participants who signed up in the Microsite that was sent to IQOS CLUB Members through SMS. The Waitlist invite is open for registration for only 24HRS after being sent. The Participant can choose to Waitlist to (1) Event only. After 24HRS of being sent, registration to Waitlist will close. If Participant is interested to attend the Event and meets all the requirements, he must:
1. Register to Waitlist attendance by confirming to the Viber or SMS sent by the Official Event Concierge; and
2. Accept Event Terms & Conditions.
ii. RSVP. The (“RSVP”) invite is contingent on whether the Participant is successfully able to register to “Waitlist. Based on the successfully registered “Waitlist” Event, the Participant will receive a scheduled invite for “RSVP” confirmation. The Participant will get the chance to join the Event if they are able to confirm “RSVP” within the allocated number of slots for the chosen Event.
iii. Participants who confirm attendance within the number of slots for the Event will be allowed access to the Event.If Participant is interested to attend the Event and meets all the requirements, he must:
1. Confirm RSVP attendance by clicking the Microsite Sign-up on the invitation sent through SMS; and
2. Accept Event Terms & Conditions.
iv. Updates. Participant will receive all essential information about the Event for registered attendees electronically via email, SMS or call.
v. Event Link. The Participant agrees that PMFTC Inc. and/or its authorized service provider will register him to the Event using his account registered in IQOS.com.
3. Prohibited Conduct
i. Attendance. Once his attendance is confirmed, each Participant will be allotted one (1) seat to the Event.
ii. Limitations on Use. By joining the Event, Participant agrees not to sell, transfer, or share their access to the Event. If PMFTC Inc. determines that they have violated this policy, PMFTC Inc. may cancel access and ban the Participant from future IQOS Events.
iii. Disruptive Conduct and Unethical/Non-Compliant Behavior. The Participant acknowledges and agrees that PMFTC, Inc. and/or its authorized service providers reserve the right to remove them from the Event if PMFTC Inc. and/or its authorized service providers in its sole discretion, among others determines that their participation or behavior violates venue regulations, local government regulations or creates a disruption or hinder the continuity of the Event or the enjoyment of the Event content by other attendees. PMFTC Inc. and/or its authorized service providers also reserve the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant behavior during the Event.
iv. No Recording, Live Streaming, and Videotaping or Posting/Sharing on Social Media. Participant agrees not to record or broadcast audio and/or video or to post/share on social media any part of the Event.
This Event is for the Participants only. By taking part in this Event, Participants agree not to share on any social media channel any posts (including images and texts) or hashtags related to PMFTC’s brands (such as IQOS etc) and products, this Event. The purpose of this Event is to provide the Participants with the opportunity to enjoy this exclusive experience.
v. In addition to the requirements and prohibitions set forth in this Section 3, PMFTC Inc. may also exclude any prospective Participant from registering or participating in any IQOS Event in PMFTC Inc.’s sole discretion.
4. Event Requirements
i. Prior to being allowed inside the Event, Participant must confirm his identity and age by presenting a government-issued ID to PMFTC Inc. and/or its authorized service providers. Valid and acceptable IDs include Passport, Alien Certificate of Registration, Driver's License, Firearms License, NBI Clearance Card, PhilHealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID, Voter's ID. Only those at least 18 years old (as of July 27, 2024) shall be allowed inside the Event premises.
ii. Participant’s companion, if any, must likewise present a government-issued ID to PMFTC Inc. and/or its authorized service providers in order to confirm his age. In addition, he must be a smoker or nicotine product user.
iii. Participant should ensure that for the duration of the Event, that there are no persons below 18 years old who will be able to view the Event.
iv. Use of IQOS will be allowed in designated vaping areas during the Event.
5. Event Souvenir
i. As a token from the Event, each Participant will be eligible to receive a souvenir from PMFTC Inc. The souvenir will be distributed by PMFTC Inc.’s authorized service provider during the Event. Thus, absence from the Event disqualifies a Participant from receiving the souvenir.
ii. The Participant understands that the souvenir is an engagement activity intended to thank Participants such as IQOS CLUB Members for their loyalty. Participants should not consider the souvenir, or any activity related to it, as prompt or a request, direct or indirect, to share any content through any social media channels. With this in mind, Participants should not share on any social media channel any posts (including images and texts) related to PMFTC Inc.’s brands and products, and the souvenir.
iii. All intellectual property rights in and to the souvenir, the content, and all materials distributed at or in connection with the souvenir are owned by PMFTC Inc. Participant may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing in the souvenir without the prior written permission of PMFTC Inc.
iv. Souvenir is limited to one per Participant.
6. Cancellation
i. If PMFTC Inc. and/or its authorized service providers are prevented from staging the Event for as a result of any cause beyond its control, or such Event cannot be virtually conducted because of a software or issue with the hosting platform or due to acts of God, strikes, labor disputes, government requisitions, restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities, or any other comparable calamity, casualty or condition (collectively a “Force Majeure”), PMFTC Inc. shall have the right to cancel or immediately terminate the Event without liability to the Participant.
7. Data Privacy Consent
i. By participating in the Event and agreeing to these Terms & Conditions, Participant also confirms his/her consent to Philip Morris International’s Consumer Privacy Notice https://www.pmiprivacy.com/en/consumer.
ii. The Participant understands that they are entitled to certain rights in relation to the personal data collected, including the right to access, correct, and object to the processing, as well as the right to lodge a complaint before the National Privacy Commission of violation of your right as a data subject. consistent with Philip Morris International’s Consumer Privacy Notice https://www.pmiprivacy.com/en/consumer.
8. Intellectual Property and Social Media Guidelines
i. All intellectual property rights in and to the Event, the content, and all materials distributed at or in connection with the Event are owned by PMFTC Inc. Participant may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at Event, in any Event content or in any materials distributed at or in connection with the Event for any reason without the prior written permission of PMFTC Inc.
ii. The Participant understands that this Event is a private activity intended to provide IQOS CLUB Members and Chosen LANUs with the opportunity to enjoy an exclusive experience. Participants should not consider this Event or any activity related to it as prompt or a request, direct or indirect, to share any content through any social media channels. With this in mind, the Participant should not share on any social media channel any posts (including images and texts) related to PMFTC Inc.’s brands and products, and this Event.
9. Disclaimer of Warranties, Limitation of Liability
i. PMFTC Inc. and its authorized service providers shall not be liable for any illness that may arise from the Participant’s willful consumption of food and/or drinks from the Event.
ii. Except as required by law, neither PMFTC Inc. nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with these Terms & Conditions.
iii. The Participant agrees to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC Inc. its affiliates and all other persons and entities connected with the Event from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that the Participant may sustain, no matter how any such property losses and/or injuries are caused.
iv. The Event, or any activity related to it, shall not be taken as precedent for future IQOS promotions.
