Terms & Conditions for participating in IQOS CLUB LOYALTY

1. Overview of IQOS CLUB Loyalty

1.1 IQOS CLUB Loyalty is a loyalty program for adult consumers of IQOS & Bonds by IQOS products, meeting the requirements of these Terms. Through IQOS CLUB Loyalty you are able to earn digital badges by completing certain actions. Badges unlock a range of Benefits once specific action, or a set of actions specified in IQOS CLUB Loyalty are completed. 

1.2 We use certain defined terms in these Terms which are in bold. A list of these defined terms is provided at paragraph 15. 

2. Application of Terms 

2.1 These terms and conditions (Terms) are applicable to and govern your participation in the IQOS CLUB program (IQOS CLUB Loyalty). You should read these Terms carefully as they affect your legal rights and govern your relationship with Us.

2.2 If you do not agree (or cannot comply) with these Terms, then you are not permitted to participate in IQOS CLUB Loyalty.

2.3 You agree to be bound by these Terms by: (i) registering for IQOS CLUB Loyalty pursuant to paragraph 4.1; (ii) registering at least one Device under IQOS CLUB Loyalty; and (ii) using Benefits of IQOS CLUB Loyalty. If you register more than one Device, you will still only have one IQOS CLUB Loyalty membership. If We change these Terms, and you then use Benefits of IQOS CLUB Loyalty, or you register another Device, you agree to be bound by the changed Terms. 

2.4 Your acceptance of these Terms is deemed to occur in the country of your registered residence as per our IQOS database. 

2.5 We reserve the right to amend these Terms and the mechanics, Benefits of IQOS CLUB Loyalty upon notice at any time. If you do not agree to any such amendments, you may terminate your membership of IQOS CLUB Loyalty. 

2.6 No modification of these Terms by you is permitted unless We expressly agrees in writing.

3. Eligibility

3.1 You are only eligible for membership of IQOS CLUB Loyalty if: (i) you are an adult smoker or IQOS user aged 21 years old and above and you are registered in Our IQOS database; (ii) your main residence is in a country where IQOS CLUB Loyalty is available; and (iii) you registered at least one Device under IQOS CLUB Loyalty. 

3.2 IQOS CLUB Loyalty membership is only open to living persons. Companies, partnerships, unincorporated associations and other legal entities are not eligible for membership.

3.3 A member of IQOS CLUB Loyalty may not have multiple memberships. You must maintain only one account in the IQOS CLUB Loyalty.

4. Registration

4.1. To register for IQOS CLUB Loyalty you must (a) register in our database at least one eligible device as described in paragraph 4.2 below (Device); (b) unlock IQOS CLUB Loyalty; and (c) receive confirmation of a successful application from Us. You can register the Device: (i) at IQOS.com; (ii) by calling the customer service center at 1500975; (iii) through an IQOS Expert; or (iv) at a participating IQOS store. 

4.2 You are able to register the following Device models for purposes of your membership to IQOS CLUB Loyalty Indonesia: 

a) IQOS 2.4, IQOS 2.4+, IQOS 3, IQOS 3 DUO, IQOS 3 Multi, IQOS ORIGINALS DUO

b) IQOS ILUMA, IQOS ILUMA PRIME, IQOS ILUMA ONE; 

c) IQOS ILUMA i, IQOS ILUMA i PRIME

d) BONDS by IQOS 

e) If applicable, any future Devices which qualify you for membership to IQOS CLUB Loyalty.

4.3 Registration on IQOS.com may take place at any time provided you are an adult user of one of the above mentioned Device models. In completing the registration process you must provide all required mandatory information in an accurate and complete manner and keep this information up-to-date. If you do not complete the mandatory fields in the application form (such as, for example, age, smoker status, email address and/or phone number) your application will not proceed. If you provide inaccurate or incomplete information, We reserves the right to terminate your membership of IQOS CLUB Loyalty without notice. 

4.4 Membership of IQOS CLUB Loyalty and Benefits it provides are personal to you, and may not be transferred to any third party. 

4.5 IQOS CLUB Loyalty is only available in certain countries. Your use of IQOS CLUB Loyalty is linked to your country of residence. If you change your country of residence, then your membership in that country automatically expires and you must inform Us and reapply to use IQOS CLUB Loyalty in your new country of residence (if IQOS CLUB Loyalty is available in that country). 

5. Earning Actions

5.1 Members may earn digital badges by completing a specific engagement or a set of engagement specified in IQOS CLUB Loyalty. Actions may include, but are not limited to, product purchases, engagements, or events participation.

5.2 Members may view the current list of required engagement and their progress through their IQOS CLUB Loyalty account. 

5.3 The required engagement are subject to change without prior notice, and We may add, modify, or remove engagement at any time at its own discretion. 

5.4 Members are responsible for ensuring timely and accurate completion of the required engagement within a defined eligibility period to earn a badge. Engagement completed outside of the eligibility period will not be counted for badge qualification. 

5.5 Certain badges or badge levels may require additional requirements or criteria to become available. These criteria will be communicated in IQOS CLUB Loyalty and may be updated or amended at any time without notice at the discretion of Us

6. Badges 

6.1 A badge is a digital recognition awarded to members for completing a specific action or a set of actions within a defined eligibility period, which may unlock associated Benefits as determined by Us

6.2. Badge Eligibility Periods:

  • Welcome Badge: The badge can be earned only one-time and has infinite eligibility period.
  • IQOS Anniversary Badge: The badge is a multi-level badge. Each level can be earned only one-time every 12 months. The badge has infinite eligibility period.
  • IQOS Switch Badge: The badge can be earned only one time within 180 days of enrollment into IQOS Club Loyalty. The badge has 1 year eligibility period since enrollment into IQOS Club Loyalty.
  • IQOS ILUMA i Badge: The badge can be earned only one time & has eligibility period of 12 months.
  • IQOS Ambassador Badge: The badge is a multi-level badge. Each level can be earned every time a referral is made, up to 15 referrals. The badge has infinite eligibility period. 
  • Flavour Master Badge: The badge is a multi-level badge. Each level can be earned by exploring different TEREA and/or BLENDS variants, up to 4 levels. The badge has infinite eligibility period.

6.3 A badge can be earned only once within its defined eligibility period. For campaign-specific badges, this means once per campaign. 

6.4 Badge requirements, eligibility criteria, and availability may vary and are subject to change at any time without notice at the discretion of Us

6.5 We retains full authority to modify badge rules, eligibility periods, or requirements as necessary, at any time without notice at the discretion of Us

7. Benefits 

7.1 Upon earning a badge, members are eligible to get the Benefit, as displayed in their IQOS CLUB Loyalty account. We makes no guarantee that specific Benefit will always remain available. Earning a badge does not necessarily mean getting a Benefit, some badges do not provide any Benefits.

7.2 Benefits associated with badges become available upon earning the badge unless otherwise stated. The Benefits may include e-voucher, access to events, or exclusive offers, which will be outlined in IQOS CLUB Loyalty. 

7.3 Benefits are non-transferable and may not be redeemed for cash. Certain Benefits may have restrictions and/or expiration dates, and We reserves the right to limit Benefits quantities, substitute Benefits, or modify Benefits offerings at any time without prior notice at the discretion of Us

7.4 We may establish additional rules regarding the redemption of Benefits, time-limitations, and special conditions for Benefits selection.

7.5. E-voucher benefits has a claim period of 2 months since you received it in your registered email account. Once you missed the claim period, you will no longer eligible to receive the e-voucher benefits.

8. Your Obligations

You agree: 

a) not to misuse the IQOS CLUB program, including its Benefits; 

b) not to obtain Benefits by fraud; 

c) to treat our staff and those of our Service Partners with courtesy and respect; 

d) to keep your membership account, including its password, safe and secure;

e) to comply with applicable law; and 

f) to comply with these Terms. 

9. Data Privacy/Communications 

9.1 We will receive, store, and otherwise process your personal information in connection with administering the IQOS CLUB Loyalty and your participation in it. To learn how we will use your personal information collected in connection with your IQOS CLUB Loyalty account, read Our Privacy Notice at https://www.pmi.com/privacy-notice. For the full Benefits of IQOS CLUB Loyalty you will receive communications from IQOS CLUB Loyalty regarding the IQOS CLUB Loyalty program. 

10. Termination and Opt-Out 

10.1 The term of your membership in IQOS CLUB Loyalty is from the date of joining to IQOS CLUB Loyalty and continues until termination of your membership according to the Terms. 

10.2 Your membership in IQOS CLUB Loyalty may be terminated at any time with immediate effect without prior notice should your eligibility change.

10.3 We may terminate your membership with IQOS CLUB Loyalty at any time with immediate effect if you breach these Terms. In addition, We may terminate your membership for any reason upon 30 days’ notice. 

10.4 Upon termination of your membership of IQOS CLUB Loyalty, you are no longer entitled to receive any of the Benefits of IQOS CLUB Loyalty, any unclaimed Benefits are cancelled automatically and your membership data are permanently deleted from IQOS internal systems. 

10.5 You may unsubscribe from IQOS CLUB Loyalty communications by opting out of marketing communications on IQOS.com at any time with immediate effect. If you choose to unsubscribe, you will not be able to receive any communications about IQOS CLUB Loyalty. 

11. Warranty/Representation/Limitation of Liability 

11.1 As your membership of IQOS CLUB Loyalty is free of charge, it is provided ‘As Is’ and without any warranty. 

11.2 We makes no representations as to any income, use, excise or other tax liability you may incur as a result of your membership of IQOS CLUB Loyalty. You are advised to check with your accountant or tax adviser for further information, and are solely responsible for any tax liability incurred as a result of your membership of IQOS CLUB Loyalty, or receipt of Benefits. 

11.3 We shall not be liable to the maximum extent permitted under applicable law whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any direct losses, loss of profits, sales, revenues or savings, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, costs, damages, charges or expenses however arising or otherwise resulting from your membership of IQOS CLUB Loyalty or your use of any of the Benefits related to the IQOS CLUB Loyalty. We shall not be liable for any of the losses described in this paragraph 11.3 even if you have informed Us of the possibility of such losses.

11.4 Nothing in this paragraph 11 excludes any liability that cannot be excluded by applicable law.

12. Ownership and Risk 

12.1 Ownership of Benefits remains with Us at all times and never passes to you. You have a right to use Benefits in accordance with these Terms. 

12.2 Risk in Benefits passes to you as soon as you redeem a Benefit. 

13. Non-Transferability 

13.1 Other than as specifically notified by Us for a particular Benefit in writing, Benefits are not redeemable for cash, refundable or exchangeable. At no time may Benefits be purchased by, sold to, bartered or otherwise transferred to any third party including any other member unless specifically authorized to do so. We may cancel any Benefits dealt with in this way. 

13.2 Any attempted sale or transfer of Benefits contrary to these Terms is a material breach and will automatically result in the termination of your membership.

14. Miscellaneous 

14.1 IQOS CLUB Loyalty is provided free of charge but We reserves the right to charge for membership in the future. You won’t be charged without prior notification and your consent.

14.3 We reserves the right to suspend or discontinue the eligibility of you or any person who uses, or, in the case of suspension, is suspected of using, IQOS CLUB in a manner inconsistent with these Terms or applicable law. In addition to suspension or discontinuance of IQOS CLUB Loyalty eligibility, We shall have the right to take appropriate administrative and/or legal action, as it deems necessary in its sole discretion. 

14.4 Our failure to enforce these Terms shall not constitute a waiver of these Terms, or any of its provision.

14.5 Upon the death of any member Badges and/or Benefits accumulated by that member are automatically cancelled. 

14.6 All questions or disputes regarding eligibility for the IQOS CLUB Loyalty, the availability of Benefits, or your compliance with these Terms will be resolved by Us in its sole discretion. The decision of Us shall be binding. 

14.7 We are not responsible for any incorrect or inaccurate information supplied by you while participating in IQOS CLUB Loyalty, nor for any lost or misdirected communications to or from you regarding the IQOS CLUB Loyalty, unless they were provided by Us.

14.8 You are responsible for maintaining updated contact information on your IQOS CLUB Loyalty account. 

14.9 Notices by Us hereunder may be made in writing including by email or through an announcement on our IQOS.com website. 

14.10 These Terms are subject to the laws of the place of Our registered office. Any legal dispute will be subject to the exclusive jurisdiction of the city in which We have Our registered office.

14.11 Any provision of these Terms declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions remaining which shall continue unaffected.

14.12 If there is any conflict in meaning between the English language version of these Terms and any version or translation of these Terms in any other language, the English language version shall prevail. 

15. Definitions

15.1 For the purpose of these Terms:

  • Benefits means the benefits, privileges, and rewards of IQOS CLUB as referenced in paragraph 7. 
  • Device means an eligible [markets to select] device model listed in paragraph 4.2.
  • IQOS CLUB Loyalty has the meaning described in paragraph 1.1. 
  • Philip Morris has the meaning described in paragraph 2.1. 
  • Terms has the meaning described in paragraph 2.1. 
  • We, Us, Our means the member of the Philip Morris International group which presented you with these terms, and which has identified itself to you when guiding you to these terms.
